Alternative Dispute Resolution

  • Alternative dispute resolution (or “ADR”) is a term referring to dispute resolution processes and techniques that act as a means for disagreeing parties to resolve a dispute without filing a public lawsuit that is heard in a courthouse. The two most common forms of ADR are mediation and arbitration.

    Mediation is usually a negotiation between two or more parties in dispute, which is conducted by an independent facilitator called a mediator. The parties are usually in separate rooms, and the mediator serves as a go-between, moving from room to room communicting the other side’s respective position. The mediator’s role is to assist the parties in reaching an amicable agreement that resolves the dispute.

    Cagle Pugh offers mediation services by a Certified Mediator, to assist parties in maintaining control and reaching a creative win-win resolution that might otherwise be unobtainable through traditional litigation.
